Dormy Care Home, Ferndown

Rund Partnership were appointed as project manager, employer’s agent, clerk of works and CDM coordinator for this project which involves the design and construction of a new 75 bed care home, including associated external works, drainage and mains services. The client has entered into a lease agreement with Care UK, a national Care Home operator, and as such, the development is being designed and constructed in accordance with their well-established design brief and performance specifications.In addition, ownership of the Care Home is to be transferred to the investor (MedicX) upon expiry of the rectification period. One of the key challenges faced was coordination of the complex discussions between the client, contractor, investor and end user during the pre-contract stages, ensuring the interests of the developer and Care UK were maintained. A key issue was also the initial contractor entering administration. We managed the process to a successful conclusion for the developer, allowing work to progress.

We have used our experience and knowledge to provide extensive advice to the client relating to contractual issues resulting from the administration of the original contractor. This has involved assessing and advising on issues relating to warranties, the performance bond and appointment of a replacement contractor. We also played a key role in discussing and preparing variations to the existing legal agreements and build contract to enable the re-commencement of works on site within a relatively short time period.

Rund Partnership added value to the project by co-ordinating the procurement process over a very short period of time due to challenging timescales dictated by the end-user. Although this process required input from numerous stakeholders and interested parties, we successfully managed to facilitate a commencement of works on site by the target date, with a completion date within the stipulated long-stop date.
